40 & OVER
2007-2008 Constitution and by-laws
This organization shall be known as the 40 & OVER BOWLING TOURNAMENT ASSOCIATION. Tournaments are USBC Certified. Membership is open to all USBC members who qualify as follows:
A. Applicants will submit all averages for prior years and will be responsible for verifications from associations other than the Greater Portland USBC. Averages from other tournament associations must also be submitted. USBC Rule 319a-3 will apply.
B. Returning members will use established tournament average for initial 14 games. New members will use high book average, based on (C) for initial 14 games and then adjusted accordingly.
C. Entering average used for tournament play will be the highest current book average. Any bowler not having a book average may also be accepted upon the approval of the Board of Directors, and at the time of participation the bowler must have a current league average of no less than 21 games and provide league verification. Any bowler not having a book average or holding a current league average of 21 games, at the time of participation, may bowl using an entering average of 220 and be handicapped accordingly. D. USBC rules 319a-2, 319a-3 apply. Rule 319d and 319e are waived. All bowlers must have reached the age of 40 before bowling any 40 & Over tournament.

The Board of Directors shall be comprised of up to 12 members plus a President, Vice-President, Sgt-at-Arms, and a Tournament Director. The board will decide on any dispute or any protest and it is within the Board's power to discipline any member for violating any provision of the constitution's rules or for conduct derogatory to the best interest of the association. The board shall have the right to expel any bowler for good and sufficient reason, with the right of appeal. If a board member misses 2 consecutive meetings without a valid excuse, he or she will be replaced. Changes to the present rules or adding new rules will require a vote of the majority of the directors voting. All suggestions regarding rules or rule changes must be in writing and presented to the board for discussion. No discussions regarding rules and regulations will take place during squad times.
- 2007-2008 annual membership dues will be $20.00. Memberships are current form the Grand Finals of one season until the Grand Finals of the next season. Membership dues must be paid before bowling the first tournament.
- Handicap will be based on 90% of 210 with a 45 pin maximum. All bowlers with averages of 210 and over will use the 100% reverse system . A bowler's average may not drop more than 20 pins from their entering average.
- Entry fee for each tournament will be: PREPAID $55.00 : ONSITE entries will be $60.00. Prepaid entries must be received no later than 3:00 PM on the Friday before the tournament. Guest entries will be $ 60.00, should a guest decide to join, and $5.00 will be applied to the balance of the membership fee being deducted from their check. A bowler may bowl only one tournament as a guest. Re-entries will be $ 50.00. From each entry $ 32.00 will go into the prize fund, $17.00 will go towards lineage $2.00 will be placed in the Grand Finals fund, $4.00 will go to the Tournament Director.
- Starting lanes will be assigned.
- Membership fee. Any guest making the finals will be required to join the association,
- Entries will close 30 minutes prior to squad time. If any squad is not filled prior to that time, walk-ins will be accepted on a first come basis. With the exception of the Grand Finals, multiple entries will be allowed: however a bowler may qualify only once for the prize list.
- Qualifying will consist of 5 games with total pins, handicap and plus pins determining up to 24 finalists. 5 plus pins will be given for each tournament a bowler does not make the finals. When a bowler makes the finals, he or she at that time will lose all plus pins accumulated. Pay-off will be on a 1-3 ratio. When holding tournaments that require more than one squad, up to 12 qualifiers from each qualifying squad will be guaranteed in the finals using our 1-3 ratio. After bowling a game, the next game may not start until all bowlers have finished. Bowlers may not move their equipment until all bowlers have finished. After the 15-minute warm-up, bowlers will go to their starting lanes. After the announcements, scoring will begin. There will be a 10-minute practice period for the bowler making the finals. After that practice there will be no further practice.
- Finals will begin after the qualifying squads. Finals will consist of 4 games. Bowlers will bowl head to head with 30 bonus pins given for each win, handicap included. Ties will be awarded 15 bonus pins. Tournament champions will receive 1 championship shirt per year. Prize money and sponsor money will be returned 100%. Should a tie occur for first place, the prize money for first and second will be added together and divided equally between the two bowlers and Champion shirts will be awarded to each bowler. Ties for other positions broken by high scratch final game. High game out of the money will receive $25.00.
- If a tie occurs for the last spot in the finals, the bowler with the highest last game scratch will receive the finals.
- There will be a minimum of 10 scheduled tournaments, including the Grand Finals. Our season begins in September and ends in July. A member must have bowled at least 5 tournaments during the season to bowl the Grand Finals.
- Grand Finals event will take up to 24 finalists on a 1-3 basis. Additional events may be held at the option of the tournament director, when appropriate, and during the months of June and August.
- Any bad check must be made good within 1 week of notification to the bowler. Bowler may not bowl another tournament until the check has been made good. A service charge of $25.00 plus all bank charges will be levied for any returned check. After a bowler has been notified, any future tournaments must be paid for with cash.
- With the exception of the Gearhart tournament, bowlers will wear a shirt with their full name on the back. New bowlers or guests will be exempt for their first tournament. Shirts may have no advertisement on the back, with the exception of the shirt manufacturer's logo. Bowlers must wear a shirt with a butterfly collar. Bowlers will wear shirts with, slacks, skirts, skorts, or walking shorts. No blue jeans will be allowed. The first infraction of the rule will result in a warning; the second infraction will result in a fine of $5.00 with the fine doubled after each following infraction. Commercial lettering must be used.
- Profanity, obscene gestures and general disturbing of bowlers and misconduct of any kind will not be tolerated. Bowlers will receive 1 warning. After being warned, the bowler will be fined $5.00, to be levied by any director on hand. Directors will be fined double. Any bowler twice fined in a tournament will be disqualified from that tournament as well as paying the $10.00 fine. Anyone fined twice in one year will be subject for review by the Board of Directors for possible expulsion from future participation.
- Any bowlers who will DNF for any reason other than medical, injury, or valid excuse will pay a fine equal to the current entry fee. Any prize money that bowler may have won will be forfeited.
- Any dispute not covered by these rules will be governed by USBC rules.
- The method used for election of officers to be determined by the board of directors
- The general membership will meet at the call of the President or the majority of the Board of Directors.
- It is the bowler's responsibility to see that his or her score sheet is signed, accounted for, and verified after each game. During qualifying rounds the leadoff left side bowler on each pair of lanes will write down all the scores and the leadoff right side bowler will be designated to verify all scored bowled on that pair. During the finals each bowler must initial opponents score . Any mistake found in addition during the finals of any tournament will be corrected after the game in progress, up until the disbursement of the prize money for that tournament
- No solicitation for entries to other associations, either written or orally, will be tolerated during 40 & Over tournament play. There will be no side pots, other than those organized by the 40 & Over. Any violation of this rule will result in a $50.00 fine.
- The 40& Over will be conducted and known as a non-profit organization.
- All equipment used must meet USBC specifications. The Board of Directors reserves the right to have any ball inspected, durometer checked, or weighed at their discretion.
- No guest entries will be accepted from employees of the center where the tournament is being held.
- There will be an All Star Team selected on a points earned basis. There will be 5 men and 2 ladies on the All Star Team. Awards will be presented at the Grand Finals.
